1. SCOPE OF WORK: The purpose of this agreement is to outline the services and products that will be
provided in connection with a photography session (hereafter referred to as "the session", "the shoot", or "SHOOT") scheduled to occur at a specific time and location. Both the CLIENT and PHOTOGRAPHER will be
present at the specified location at the designated time. After the shoot, PHOTOGRAPHER will provide
CLIENT with a minimum of ____________ images for review, and is not obligated to supply more than
this amount. PHOTOGRAPHER will perform basic post-processing or digital image editing on these
photos if necessary.

2. FEES: In exchange for the photography services provided by the PHOTOGRAPHER, the CLIENT agrees
to pay a certain amount as specified in this agreement. As part of the payment terms, the CLIENT agrees
to make an initial non-refundable payment of 50% of the total cost upon signing this contract. The initial
payment serves to reserve the photographer's time and is not a retainer or deposit. The
PHOTOGRAPHER also agrees not to offer the same time slot to other clients during this period. If the
CLIENT cancels the shoot for any reason, the initial payment will not be refunded. The remaining
payment for photography services must be paid in full within 7 days after the scheduled SHOOT as
outlined in Section 1: SCOPE OF WORK. If the CLIENT decides to purchase additional photos after the
SHOOT, payment for those photos is due immediately upon delivery.

3. WORK PRODUCT: PHOTOGRAPHER will edit the photos taken during the shoot as necessary for artistic
purposes. Within 30 days after the shoot, PHOTOGRAPHER will provide CLIENT with proof of the photos
taken during the shoot, which are the exclusive property of PHOTOGRAPHER. CLIENT is licensed to
review the proofs, but not to store them. The photos delivered to CLIENT are only licensed for personal
use and cannot be used for any other purposes.

If photos are not included in the price for photography services, all photos must be purchased
separately. If photos are included in the price, the number of photos included and the resolution of the
photos will be specified. The contract will also specify the number of prints included in the price, the
sizes of the prints, and the materials that will be used for printing. CLIENT acknowledges that the
delivery of prints may take longer than the delivery of digital files. PHOTOGRAPHER will deliver the
photos in a reasonable amount of time after CLIENT has placed their final order.

4. INDEMNIFICATION:

4.1 - It is agreed between PHOTOGRAPHER and CLIENT that PHOTOGRAPHER is not obligated to capture
any specific moment, pose, or individuals during the SHOOT.

4.2 - In the event that PHOTOGRAPHER is unable to perform the services outlined in this contract due to
factors beyond its control, CLIENT agrees to indemnify PHOTOGRAPHER for any loss, damage, or liability.
However, PHOTOGRAPHER will refund all payments made by CLIENT in relation to this SHOOT.

4.3 - CLIENT agrees to hold PHOTOGRAPHER harmless for any damage, loss, or liability resulting from
technological failure, including data loss.

4.4 - CLIENT understands and acknowledges that PHOTOGRAPHER is not obliged to retain copies of the
photos from this SHOOT for more than 60 (sixty) days after delivering them to CLIENT.

4.5 – CLIENT agrees to release PHOTOGRAPHER from any liability for personal injury that may occur
while working with or posing for the PHOTOGRAPHER.

4.6 – While PHOTOGRAPHER will strive to present photos in a professional manner, CLIENT understands
and agrees that PHOTOGRAPHER is not obligated to cater to specific aesthetic preferences of the
CLIENT.

5. DUTY OF CLIENT: CLIENT is responsible for obtaining all necessary permissions for PHOTOGRAPHER to
conduct photography at the SHOOT. PHOTOGRAPHER is not obligated to obtain permission from
reception centers, churches, buildings, properties, or any other locations to conduct photography.
CLIENT acknowledges and agrees that any fines imposed on the photographer or any prevention of
photography at the event due to the failure to obtain these permissions is not the fault, liability, or
responsibility of the photographer.

6.EXCLUSIVE PHOTOGRAPHER: CLIENT acknowledges and agrees that only PHOTOGRAPHER is permitted
to capture photographs of any poses, lighting conditions, or setups created by them. Allowing others to
do so can disrupt the photographer's workflow and infringe on their right to document the event. CLIENT assumes responsibility for ensuring that no one obstructs the photographer's work or takes
photos during these situations.

7. MODEL RELEASE: CLIENT authorizes PHOTOGRAPHER, its assigns, licensees, and sublicensees to use
CLIENT's image or likeness in various forms of media for commercial purposes, advertising, trade,
personal use, or other purposes. This grants PHOTOGRAPHER permission to use CLIENT's image on their
website or other advertising, and to sell photos that include CLIENT's likeness to third parties.

8. ASSIGNABILITY AND PARTIES OF INTEREST: CLIENT acknowledges and accepts that this contract does
not guarantee a particular photographer to perform the photography services. PHOTOGRAPHER has the
right to subcontract or delegate the photography services to another qualified photographer or second-
shooter if necessary. In such cases, the delegated photographer or second-shooter will be capable and
skilled enough to deliver the services in a competent and professional manner, in accordance with this
contract.
